This Platform is intended only for adults and that you are eligible to contract as per applicable laws. If you are using/accessing this Platform as a representative of any person/entity, you acknowledge that you are legally authorized to represent that person/entity. Minors, i.e. users under 18 years of age, are only allowed to access the Platform with prior approval of their legal guardian.

IN NO EVENT SHALL NIMIDZA, ITS OFFICERS, EMPLOYEES, OR AGENTS, BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, RESULTING FROM ANY ASPECT OF YOUR USE OF THE PLATFORM OR THE SERVICE, INCLUDING WITHOUT LIMITATION WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE PLATFORM OR THE SERVICE, FROM INABILITY TO USE THE PLATFORM OR THE SERVICE, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE PLATFORM OR THE SERVICE. SUCH LIMITATION OF LIABILITY SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE PLATFORM OR THE SERVICE OR ANY LINKS ON THE PLATFORM, AS WELL AS BY REASON OF ANY INFORMATION, OPINIONS OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE PLATFORM OR THE SERVICE OR ANY LINKS ON THE NIMIDZA SITE. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT NIMIDZA SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY USER OR THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. THE PLATFORM IS CONTROLLED AND OFFERED BY NIMIDZA. NIMIDZA MAKES NO REPRESENTATIONS OR WARRANTIES THAT THE PLATFORM IS APPROPRIATE FOR USE IN OTHER LOCATIONS. THOSE WHO ACCESS OR USE THE PLATFORM FROM OTHER JURISDICTIONS DO SO AT THEIR OWN VOLITION AND RISK AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAW.

4.NIMIDZA reserves the right to alter, amend, modify or terminate the service or access to the service at any time, with or without cause. NIMIDZA reserves the right, in its sole discretion, to terminate your access to the NIMIDZA Listing services and the related services or any portion thereof at any time, without notice.
5.To avail of and use the NIMIDZA Services you may have to register with NIMIDZA. As a part of registration process you agree to provide NIMIDZA your current, complete, and accurate registration information as prompted to do by the Service and to maintain and update this information as required to keep it current, complete and accurate. If you provide any information that is untrue, inaccurate not current or incomplete if NIMIDZA has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, NIMIDZA has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to NIMIDZA's Services. If any point of time NIMIDZA may come to know that the user is below the age of 13 years then NIMIDZA reserves its right to delete the said user's account after observing due diligence

By submitting the information to us, you represent and warrant that such submission is accurate, is not confidential and is not in violation of any contractual restrictions or other third party rights. You must consider and decide yourself the extent to which you wish to reveal information about yourself to the large community of Nimidza.com users and to Nimidza.com. You Nimidza you must not communicate any information which could be harmful/damaging/detrimental to you.
Nimidza.com offers various services such as chat rooms, blogs, etc, where you can post and share your views, observations and comments on various issues/designated topics. Nimidza.com cannot guarantee that the other members will not use the ideas and information that you share. Therefore, if you have an idea or information that you would like to keep confidential and/or don't want others to use, do not post it on the service.
You further agree, understand and acknowledge that Nimidza.com is a intermediary/service provider which facilitates/provides access to the communication system over which the information is made available by the third parties. As such Nimidza.com does not
(a) initiate the said transmission or
(b) select the receiver of said transmission or
(c) select or modify the information contained in the said transmission.
Nimidza.com is under no obligation to monitor or review the user contributed content. Nimidza.com assumes no responsibility for the content, no obligation to modify or remove any inappropriate messages/content and no responsibility for the conduct of any user of this service. However, Nimidza.com reserves the right to review the content posted and to remove any content in its sole discretion. Nimidza.com does not permit or authorize infringement of intellectual property rights and reserves the right to remove the content without any prior intimation, upon proper notification that such member uploaded content infringes the intellectual property rights including the copyright of the rightful owner. The information/content provided on this site is intended for personal non-commercial use. Other than what is expressly provided herein, you agree and undertake not to download, use, copy, reproduce, distribute, display, broadcast, sale, license or otherwise exploit for any purpose any content without the prior written consent of the respective rightful owners.
Nimidza.com reserves the right to release current or past member information that Nimidza.com believes is in violation of the terms of service or privacy guidelines, or used to commit unlawful acts, or if the information is subpoenaed, or a request is received from the law enforcement agencies or a court order and/or if Nimidza.com deems it necessary and/or appropriate.
This Agreement is governed and construed in accordance with the Laws of Union of India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Mumbai, Maharashtra, India, in all disputes arising out of or relating to the use of the Nimidza sites/services. Use of the Nimidza sites/services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree to indemnify and hold Nimidza.com, its subsidiaries, affiliates, officers, directors, employees, and representatives harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on the Nimidza sites/services.
Data Retention, Account Deletion, and Termination
Account Deletion by User
You may request deletion of your account and associated data at any time by using the features available in your account settings or by contacting our designated Grievance Officer. Upon receiving a valid request, we shall initiate deletion of your personal data and content in accordance with the Digital Personal Data Protection Act, 2023 ("DPDP Act") and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules").
The deletion process will be completed within 30 (thirty) business days, except where retention is required under applicable law.
Account Status Upon Death of User
In the event of the death of a user, their legal heir(s), nominee(s), or duly authorized representative(s) may request access to, or deletion of, the deceased user's account by submitting
Data Retention Obligations
Even after account deletion (whether by user request or due to death), we may retain certain data where necessary:
All retained data will be stored securely in compliance with Section 43A of the IT Act and the SPDI Rules, ensuring reasonable security practices are followed.
Unless otherwise required by law, personal data and associated content will be deleted or irreversibly anonymized within 90 (ninety) days from the date of account deletion or deactivation.
Backup and Recovery Limitations
Please note that residual copies of deleted data may remain temporarily in backup storage systems maintained for business continuity and disaster recovery purposes. Such backups will not be accessible for routine business operations and will be purged within 90 (ninety) days of account deletion unless longer retention is mandated by law.
Finality of Deletion
Account deletion is final and irreversible. Upon deletion, we will be unable to retrieve or restore any data, including emails, contacts, stored files, or associated metadata.
